By providing your mobile phone number, registering for an event, or engaging our services, you agree to these terms. We've written this in straightforward language because clarity builds trust. SMS Messaging Program Terms

Your Consent to Receive Messages

By providing your mobile phone number and opting in, you expressly agree to:

Receive automated marketing and transactional text messages from The Cup Bearer

Receive messages at the mobile number you provided

Confirm that you are the wireless account holder or have authorization to enroll this number

Understand that consent is not a condition of purchase—you can attend our events without opting in

Your opt-in constitutes your written signature authorizing The Cup Bearer to deliver SMS messages using an automatic telephone dialing system.

What You'll Receive

Message Types:

Transactional: Event confirmations, ticket details, schedule updates, venue information, last-minute changes

Marketing: Upcoming event announcements, early-bird opportunities, exclusive experiences, speaker/talent reveals

Service: Important notifications about cancellations, date changes, venue updates, safety information

Community: Industry insights, content from our network, partnership opportunities, behind-the-scenes updates

Message Frequency: Approximately 4-8 messages per month. Frequency varies based on:

Your event registrations and attendance

Active event seasons and production schedules

Time-sensitive announcements and exclusive opportunities

Industry updates and community news

We respect your time and attention. We'll never spam you.

Message & Data Rates

Cost: The Cup Bearer does not charge you for text messages. However, standard message and data rates may apply based on your mobile carrier's plan. Check with your carrier about SMS charges and data usage.

Supported Carriers

This program works with major U.S. carriers, including:

AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, Alltel, Google Voice, and most other carriers.

If you experience issues receiving messages, contact your carrier to confirm SMS capabilities.


How to Stop Messages (Opt-Out)

You control your inbox. You can stop receiving messages at any time using any of these methods:

UNSUBSCRIBE

You'll receive one final confirmation message, then no further messages unless you opt back in.

Service Agreements:

These Terms of Service supplement (but don't replace) your contract

Client Responsibilities:

Provide accurate information, assets, and requirements in a timely manner

Secure necessary permits, licenses, and insurance as specified

Review and approve deliverables within agreed timeframes

Make payments according to the agreed schedule

Communicate changes or concerns promptly

Our Responsibilities:

Deliver services as outlined in the service agreement

Maintain professional standards and industry best practices

Communicate proactively about project status

Coordinate vendors and manage production elements as agreed

Provide post-event reporting and assets as specified

Payment Terms

Deposits are typically 50% upfront, with balance due before or at event execution

Late payments may incur fees and delay service delivery

Refund policies vary by service type and project stage

Additional services beyond scope will be quoted separately


Program Changes & Modifications

The Cup Bearer reserves the right to modify:

Message frequency or content

Program features or benefits

Program availability or offerings

You'll be notified of material changes via:

Text message to opted-in numbers

Email to your address on file

Continued participation after changes indicates your acceptance. If you disagree with changes, you can opt out at any time.

Program Termination

We may suspend or terminate the SMS program or your participation if:

You violate these terms

Your number is no longer valid

Abusive or inappropriate conduct toward our team


Message Delivery & Technical Limitations

No Guarantee of Delivery

While we use reliable systems, we cannot guarantee:

Messages will always be delivered

Messages will arrive at a specific time

Service won't be interrupted by carrier or technical issues

Your device will receive messages (check with your carrier)

We are not responsible for:

Delayed, failed, or undelivered messages

Carrier or network issues

Phone number changes you don't report to us

Device or software compatibility issues

Messages you delete before reading

Missed event information due to delivery failures

Your Responsibilities

You agree to:

Provide accurate contact information

Notify us promptly of phone number changes

Maintain a compatible device and active service

Comply with your carrier's terms of service

Not use the service for unlawful purposes

Check your messages regularly for time-sensitive event updates


Conduct & Behavior Standards

At Our Events

Attendees agree to:

Treat all attendees, staff, vendors, and venues with respect

Follow venue rules and safety protocols

Refrain from disruptive, threatening, or inappropriate behavior

Not engage in harassment, discrimination, or illegal activity

Consume alcohol responsibly (when served)

Respect intellectual property and confidential information shared

We reserve the right to:

Remove anyone violating these standards without refund

Ban individuals from future events

Involve law enforcement if necessary

Share information with venues or other event organizers for safety purposes

Content & Photography

By attending our events:

You consent to being photographed or recorded

We may use photos/videos featuring you in marketing (without compensation)

You may photograph for personal use unless specifically restricted

Professional photography/recording requires advance permission

You agree not to record speakers or content for commercial purposes


Liability & Disclaimers

Service "As Is"

SMS messages, events, and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

Merchantability

Fitness for a particular purpose

Non-infringement

Accuracy or reliability of information

Uninterrupted or error-free operation

Educational or business value of content

Assumption of Risk

You acknowledge that:

Event attendance carries inherent risks (travel, health, venue conditions)

You participate voluntarily and at your own risk

We're not responsible for accidents, injuries, or losses at events

Alcohol service (when applicable) is your responsibility to consume safely

Networking and business opportunities are not guaranteed outcomes

Limitation of Liability

To the maximum extent permitted by law, The Cup Bearer and its owners, employees, contractors, partners, speakers, vendors, and venues are not liable for:

Any indirect, incidental, special, consequential, or punitive damages

Lost profits, revenues, business opportunities, or reputation

Damages resulting from event cancellations, changes, or technical failures

Third-party actions, venue issues, or force majeure events

Personal injury or property damage at events (unless due to our gross negligence)

Any damages exceeding the amount you paid us in the past 12 months

This applies whether based on warranty, contract, tort, or any other legal theory, even if we've been advised of the possibility of such damages.

Exceptions

Some jurisdictions don't allow limitation of certain warranties or liability, so some of the above may not apply to you. You may have additional rights that vary by location.


Privacy & Data Use

Your personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

Intellectual Property

Our Content

All content created or produced by The Cup Bearer—including event concepts, branding, marketing materials, curriculum, proprietary processes, presentations, videos, photos, and intellectual property—is owned by The Cup Bearer or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

Reproduce, distribute, or publicly display our content without permission

Use our name, logos, or trademarks without written consent

Record or reproduce event content for commercial purposes

Reverse engineer our processes or systems

Scrape or harvest data from our platforms

Client Work Product

For event production clients:

We retain rights to our creative processes and methodologies

You receive rights to deliverables as specified in your service agreement

Portfolio usage rights are typically retained (with client approval)

Confidential client information is protected per your agreement

User-Generated Content

If you share photos, testimonials, or content mentioning The Cup Bearer:

You grant us a non-exclusive license to use, share, and feature your content

You confirm you own the rights or have permission to share it

You agree it doesn't violate anyone's rights or applicable laws

We may use it in marketing with credit to you (unless you request otherwise)


Indemnification

You agree to indemnify, defend, and hold harmless The Cup Bearer, its owners, officers, employees, agents, contractors, speakers, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

Your violation of these Terms of Service

Your violation of any law or third-party rights

Your conduct at events or interactions with other attendees

Your use of our services, SMS program, or content

Any false or misleading information you provide

Your breach of confidentiality or intellectual property rights


Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in , Connecticut.

Informal Resolution First

Before filing any claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We'll work in good faith to reach a fair resolution within 30 days.

Arbitration Agreement (Optional - Remove if not desired)

Class Action Waiver (Optional - Remove if not desired)

You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.

Exceptions

Either party may seek injunctive relief in court for intellectual property violations or unauthorized access to systems without first attempting informal resolution.


General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and The Cup Bearer regarding our services, superseding any prior agreements or representations.

Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision will be modified to be enforceable while preserving the intent.

No Waiver

Our failure to enforce any right or provision doesn't waive our right to enforce it later. Any waiver must be in writing and signed by The Cup Bearer.

Assignment

You may not transfer or assign your rights under these Terms without our written consent. We may assign our rights to affiliates or in connection with a merger, acquisition, or sale of assets.

Force Majeure

We're not liable for delays, cancellations, or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, government restrictions, venue issues, terrorism, strikes, or technical failures.

Survival

Provisions that by their nature should survive termination (including liability limitations, indemnification, intellectual property, and dispute resolution) will survive termination of these Terms.

Independent Contractors

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and The Cup Bearer.
